TradeMark is a mark capable of being represented graphically and which is capable of distinguishing the goods or services of one person from those of others and may include the shape of goods, packaging, and combination of colors. The governing act for trademarks in India is the Trade Marks Act, 1999.                     

Any business with a registered trademark has the exclusive right to use the said registered trade mark i.e. right to exclude others from using similar or deceptively similar Trade Marks.
